By accessing this website or submitting an enquiry, you acknowledge that you have read and understood these Terms and Conditions. Use of this website is available only to persons who are 18 years of age or older and who have the legal capacity to enter into binding agreements. If you do not accept these terms, please discontinue use of this website.

The information on this website is provided for general information purposes and does not constitute legal advice. No client-lawyer relationship is formed by accessing or using this website. A client-lawyer relationship is only established upon execution of a written Engagement Letter. If you require legal advice specific to your situation, please contact us to arrange an initial review.

4. Service Description

Pactum provides personal injury legal services to clients in Malaysia. Services are offered through three engagement types:

  1. Initial Case Review and Steady Counsel Engagement — RM 680
  2. Insurance Claim and Settlement Engagement — RM 1,400
  3. Comprehensive Personal Injury Litigation Engagement — RM 2,150

The specific scope of each engagement is set out in the relevant Engagement Letter. Services are subject to geographic scope limitations and to the terms of the Engagement Letter.

5. Engagement Process

No legal work is performed until an Engagement Letter has been signed by both parties. The Engagement Letter sets out the scope of the work, the fee, and the process to be followed. Commencement of an initial review does not create any obligation to proceed to a further engagement.

6. Payment Terms

Fees are denominated in Malaysian Ringgit (RM). Payment terms are set out in the Engagement Letter. Fees for the initial review are payable prior to or at the commencement of the session. For further engagements, payment schedules are agreed in the Engagement Letter.

All fees are exclusive of any applicable taxes, court filing fees, expert witness fees, or other disbursements unless expressly stated otherwise. Disbursements are discussed with the client before they are incurred.

To the extent permitted by Malaysian law, Pactum's liability in connection with any engagement is limited to the fee paid for that engagement. We are not liable for indirect, consequential, or speculative losses. This limitation does not apply where liability cannot be limited by law, including liability for professional negligence to the extent covered by professional indemnity insurance.

We maintain strict confidentiality in respect of all information shared with us in the course of an enquiry or engagement, in accordance with the professional conduct rules of the Malaysian Bar and applicable law. See our Privacy Policy for information on personal data handling.

12. Termination

Either party may terminate an engagement by written notice. The terms for termination, including any fee obligations for work carried out prior to termination, are set out in the Engagement Letter. We may decline to act for any person where there is a conflict of interest or where doing so would breach our professional obligations.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising in connection with these Terms or with any engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia. In the event of a dispute, we encourage the parties to attempt informal resolution in the first instance by writing to [email protected].

Complaints about the conduct of our legal practice may also be referred to the Malaysian Bar Complaints Committee.

14. General Provisions

If any provision of these Terms is found to be unenforceable, it will be severed and the remaining provisions will continue in full force. These Terms constitute the entire understanding between the parties with respect to the subject matter hereof, subject to any Engagement Letter in force. No waiver of any term shall constitute a continuing waiver.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when published on this website. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the website following a change constitutes acceptance of the revised Terms.
