Road accident, North-South Expressway — Disputed liability

Challenge

The client was injured in a multi-vehicle accident where liability was contested by both insurers. The client had sustained soft tissue injuries requiring physiotherapy over several months. Documentation from the immediate aftermath was incomplete.

Approach

An initial review established which documentary gaps needed to be addressed first. A medical report and physiotherapy records were obtained and organised into a coherent submission. Correspondence with both insurers was conducted calmly, with a written record provided to the client at each exchange.

Outcome

Settlement reached within five months. The quantum reflected general damages for pain and suffering and special damages for medical expenses and income lost during recovery. The client was kept informed of the basis for each figure throughout the negotiation.

Workplace injury, manufacturing facility — Occupational health dispute

Challenge

A factory worker sustained a hand injury when a piece of machinery was operated without safety guards in place. The employer disputed that the absence of guards was a breach of any duty. A SOCSO claim had been submitted but not yet assessed. The worker was uncertain whether a civil claim was viable alongside the SOCSO process.

Approach

The initial review mapped the relationship between the SOCSO claim and the civil liability question. It was confirmed that the two routes could proceed in parallel. An occupational health specialist was instructed to assess the long-term functional impact. The litigation engagement was recommended given the employer's contested position.

Outcome

The matter settled prior to trial following the production of the occupational health report. The settlement included general damages, loss of earnings during the recovery period, and an amount reflecting future earning capacity. The SOCSO claim ran alongside and was not compromised by the civil settlement.
